GolfAI / Legal
Terms of Use
Version 2026-10-01 — draft · Effective date: {{Effective date}}
These terms apply when you use the GolfAI practice app. Please read them with the Privacy Policy, which explains what we collect, where it is stored and who processes it.
1. Accepting these terms
GolfAI is operated by {{Company legal name}} (ABN {{ABN}}), {{Registered address}} (“GolfAI”, “we”, “us”). By creating an account or using the app you agree to these terms. If you do not agree, do not use the app.
When you register we ask you to agree to these terms and the Privacy Policy together (the “service” agreement). The Privacy Policy is not a contract term, but it describes how we handle your information and the separate choices you have: AI processing, and optional model improvement. We record the version you agreed to.
2. Who can use GolfAI
Invitation. GolfAI is a pilot service. You may register only if a participating club, venue or coach has invited you.
Age. You must be {{Minimum age}} or over. You state your age when you register, and it must be true.
Under 18. If you are under 18, a parent or guardian must read these terms and the Privacy Policy with you and agree on your behalf before you use the app. The registration form asks for this, and an account created before the form asked is asked the next time the app is opened. We store the guardian’s name and contact. The guardian is responsible for your use of the app.
Keep one of the two options below and delete the other.
Option A — Australia only (delete if not chosen)
GolfAI is offered only to people located in Australia. You must not register if you are located elsewhere.
Option B — Australia and mainland China (delete if not chosen)
GolfAI is offered to people located in Australia and in mainland China. If you are located in mainland China:
the service is provided to you by {{China contracting entity}};
if you are under 14, your parent or guardian must consent before you use the app;
the additional mainland China terms in the Privacy Policy apply to your personal information. {{Lawyer to confirm licensing and filing requirements for offering the app and its AI features in mainland China}}
3. Accounts and passwords
Give accurate details when you register and keep them up to date.
Keep your password confidential and do not share your account. You are responsible for what is done through your account unless it results from our failure to take reasonable care.
Tell us promptly if you think someone else has used your account.
Sign-in sessions end after 12 hours, after which you sign in again.
4. What GolfAI is, and is not
GolfAI is a training aid. It stores photos and videos of your practice, lets you and your coach view, compare and label them, and can add AI-assisted observations and coaching feedback.
AI-generated. Posture observations, coach reviews, chat replies and tips are generated by AI models. Spoken coaching uses an AI-generated voice, not a recording of a person. AI output can be wrong, incomplete or inconsistent.
Not a judgement of your whole swing. Observations describe visible posture and body keypoints in what the camera captured. Camera angle, lighting and anything blocking the view affect the result. A still image cannot establish movement, impact timing or true weight distribution.
Not a measurement. GolfAI is not a launch monitor. It does not measure ball speed, spin, launch or distance.
Not medical or professional advice. GolfAI does not give medical, physiotherapy or injury advice, and it is not a substitute for a qualified coach’s judgement. If you have pain or an injury, stop and see a health professional.
You practise at your own pace and within your own physical limits. Use the feedback as a starting point, with your coach’s judgement.
5. AI features
The AI features (posture and keypoint analysis, the live pose check, AI coach review and chat, quick coach tips, voice teaching and the live voice coach) send your recordings, camera frames, voice and body keypoints outside the Sydney server, including to mainland China and the United States, as the Privacy Policy describes.
They run only if you have given the separate AI processing agreement. Without it you can still store, view, compare and label practice and use highlights. You can change this choice at any time in the app: Your account, then Privacy, then Privacy choices. If someone else asks for AI analysis of your recording, your choice applies.
6. Acceptable use
You agree that you will:
only record people who have agreed to be recorded, and keep bystanders out of frame; remember that videos include sound;
follow the venue’s filming rules and any directions from venue staff;
place your phone or camera on a stable stand, clear of the swing area and the path of the club and ball, and keep yourself and others clear of the swing area;
not upload content that is unlawful, that infringes someone else’s rights or privacy, or that is abusive, sexual or otherwise unrelated to golf practice;
not try to access another person’s account or data, interfere with the service, get around its access controls, or use automated means to copy it;
not use the app to record or monitor a person without their knowledge.
7. Your content
You own the photos, videos and other content you upload. You are responsible for it, and you confirm that you have the right to upload it and the agreement of anyone who appears or can be heard in it.
You give us a non-exclusive, royalty-free licence to host, store, copy, process and display your content for the purpose of providing the service to you and to the coaches and venue staff who have access to your practice. Where you use the AI features, this includes sending it to the processors listed in the Privacy Policy. The licence ends when the content is deleted, apart from backup copies that roll out as the Privacy Policy describes.
Only if you switch on the optional model improvement choice, the licence also covers using your content to evaluate, improve and train our models. That choice is off by default and you can switch it off at any time; the Privacy Policy explains what switching off does.
We do not use your content to advertise GolfAI without asking you first.
8. Coaches and venues
GolfAI is used with clubs, venues and coaches. Administrator accounts can see every student’s practice. Coach accounts can see every student’s practice, or only that of the students assigned to them, depending on how the service is set up (see section 6 of the Privacy Policy). Where a coach or administrator can see your practice, that includes recordings, analyses, AI feedback, labels and highlights, and they can add labels and notes and delete recordings. Administrators can also create, disable and reset accounts.
Coaches and venues are independent of GolfAI. Their advice, lessons, bookings and venue rules are their own responsibility, and your arrangement with them is separate from these terms.
If you are a coach or venue staff member, you must use your access only for coaching the students you work with, and keep what you see confidential.
9. Availability and changes
GolfAI is a pilot (beta) service. Features may change, be limited or be withdrawn, and the service may be unavailable at times, including for maintenance or because a computing or AI provider is unavailable. We do not promise that the service will be uninterrupted or error-free. Keep your own copies of recordings that matter to you.
{{Fees: confirm that the pilot is free of charge to students, or insert pricing terms}}
10. Intellectual property
The app, its software, design, text, reference material and the GolfAI name and mark belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app for your own practice or, if you are a coach, for coaching your students. You must not copy, modify, reverse engineer, resell or sublicense it, except where the law permits this despite these terms.
11. Australian Consumer Law and liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified.
Where the Australian Consumer Law applies and permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
Subject to the two paragraphs above, and to the extent the law permits:
we provide the service “as is” during the pilot and give no warranties beyond those the law requires;
we are not liable for loss or injury to the extent it results from your reliance on AI-generated output as if it were professional, medical or measured advice, from how you set up your equipment or practise, or from your breach of these terms;
we are not liable for indirect or consequential loss, or for loss of data that you could have avoided by keeping your own copies;
our total liability to you in connection with the service is limited to {{Liability cap}}.
Nothing in these terms limits liability that cannot be limited by law, and our liability is reduced to the extent you contributed to the loss.
{{Lawyer to review this section, including the unfair contract terms regime}}
12. Suspension and termination
You may stop using GolfAI at any time and may ask us to close your account (section 13).
We may suspend or close your account if you seriously or repeatedly breach these terms, if we need to do so to protect other people or the service, if the club, venue or coach that invited you stops taking part, or if the pilot ends. Where it is reasonable to do so we will give you notice and a chance to save your recordings first.
13. Deleting your account
You can delete individual recordings in the app. Deleting a whole account is being added to the app: {{Confirm in-app path for account deletion and data export}}. Until that is available, ask our contact below and we will close the account for you. The Privacy Policy explains what is removed and how long copies can remain in backups.
14. Changes to these terms
These terms carry a version number; this is version 2026-10-01. When we publish a new version, signed-in students are asked to review it the next time they open the app. If you do not agree to a new version, you may stop using the app and ask us to close your account. We will not use a change to these terms to switch on AI processing or model improvement for you; those always need your own choice.
15. Governing law
Keep one of the two options below and delete the other.
Option A — Australia only (delete if not chosen)
These terms are governed by the laws of {{Governing law state}}, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State or Territory.
Option B — Australia and mainland China (delete if not chosen)
If you are located in Australia, these terms are governed by the laws of {{Governing law state}}, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State or Territory.
If you are located in mainland China, {{Governing law and dispute resolution for mainland China users}}. Nothing in these terms removes rights you have under mandatory consumer protection or personal information law in mainland China.
